1. Introduction and Acceptance of Terms

Welcome to Deep Evidence, an innovative Artificial Intelligence (AI) platform developed to assist professionals in life sciences and related fields in their research and practice activities. These Terms of Service ("Terms") establish the rules and conditions governing the use of products and services offered by AnestCopilot LTDA ("we", "our", or the "Company"), operating the Deep Evidence platform.

By accessing or using our services through the deepevidence.ai website or associated application, you ("user" or "you") acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy, which is an integral part of this document. If you do not agree with any part of these Terms, please do not access or use Deep Evidence services.

It is important to note that these Terms have been carefully drafted in accordance with current Brazilian legislation, including, but not limited to:

  • General Data Protection Law (LGPD) – Law No. 13,709/2018
  • Internet Civil Framework – Law No. 12,965/2014

2. Detailed Description of Services

Deep Evidence is an Artificial Intelligence (AI) platform meticulously designed to assist professionals in life sciences and related fields (such as doctors, researchers, nurses, physiotherapists, physical educators, managers, among others) in their research needs and access to scientific information. Our mission is to provide advanced tools that enhance evidence-based decision-making, facilitate quick and accurate access to updated information, and optimize research workflows.

Our services include the following specialized tools:

2.1. Deep Review:

This tool performs an in-depth search and analysis of hundreds of scientific articles to answer a user's complex question.

Features: Comprehensive analysis of relevant literature, direct and detailed response in under 2 minutes, references embedded in the text and listed at the end, accessible with one click. Ideal for obtaining a robust overview of a topic and supporting decisions.

2.2. My Article:

Allows conversational and in-depth interaction with the content of a specific scientific article, provided by the user (PDF upload) or via a link to an open-access article.

Features: AI reading and understanding of the article, suggestion of discussion topics with hyperlinks, Q&A interface about the content in the user's desired language, summarization of specific sections. Facilitates quick understanding and overcomes language barriers.

2.3. My Update:

Actively and passively monitors new articles published on topics of interest defined by the user.

Features: Notification of new relevant publications, presentation of article summary and access link. Ensures continuous updating without active search effort.

2.4. PubMed Search:

Performs targeted searches in the PubMed database directly through the Deep Evidence platform.

Features: Keyword search with relevance or recency filters, direct access to PubMed results, option to interact with returned articles via "My Article". Streamlines the initial search process.

2.5. Concise Review:

Provides a quick (in seconds) and concise answer, offering a general overview of the user's question.

Features: Ultra-fast response generation, overview of the topic, referenced. Useful for quick queries or as a starting point for deeper analysis.

2.6. My Researches:

Organizes and stores the entire history of searches performed by the user within Deep Evidence.

Features: Listing of searches by tool used and date, search bar for access to previous information. Facilitates knowledge management and retrieval of prior searches.

It is fundamental to understand and accept that:

  • The Deep Evidence platform is powered by AI algorithms that process information from scientific databases like PubMed and articles provided by users, aiming to provide quick and referenced answers.
  • Despite our efforts to provide accurate and evidence-based information, Deep Evidence does not, under any circumstances, replace the qualified professional judgment of the user (whether a doctor, researcher, physiotherapist, etc.). All professional, clinical, or research decisions are the sole responsibility of the professional.
  • The user acknowledges that, like any AI-based technological tool, Deep Evidence may contain errors, inaccuracies, or limitations in the interpretation or scope of the literature. Therefore, the user commits to using their professional judgment in all decisions, not relying solely on the information provided by the platform.
  • Deep Evidence is a tool to support research and decision-making and should not be considered a substitute for academic/professional training, practical experience, critical reading of original literature, or guidelines and protocols established by competent authorities and professional/scientific societies.

3. Conditions of Access and Use of Services

3.1. Account Creation and Maintenance

Access to Deep Evidence services is granted upon creation of a personal, non-transferable account. By creating an account, you agree to:

  • Provide true, accurate, current, and complete information about yourself.
  • Maintain and promptly update your registration data to keep it true, accurate, current, and complete.
  • Be solely responsible for the confidentiality and use of your password and username.
  • Notify the Company immediately of any unauthorized use of your account or any other breach of security.
  • Be entirely responsible for all activities that occur under your account.

3.2. Appropriate Use of Services

By using Deep Evidence services, you agree to:

  • Use the services only for lawful purposes and in accordance with these Terms.
  • Not use the services in a way that could damage, disable, overburden, or impair Deep Evidence servers or networks.
  • Not attempt to gain unauthorized access to any part of the services, other systems, or networks connected to Deep Evidence services.
  • Not use the services to generate, store, or transmit illegal, defamatory, fraudulent material, or material that violates the privacy or rights of third parties.
  • Not reverse engineer, decompile, or disassemble any part of the services.
  • Use your critical professional judgment in all decisions, recognizing that Deep Evidence is a support tool and not a substitute for specialized knowledge and critical information analysis.

3.3. Restrictions and Limitations of Use

The Company reserves the right to:

  • Modify, suspend, or discontinue any aspect of the service at any time, with or without notice.
  • Limit the use or access to the service, remove or edit content at its sole discretion.
  • Monitor the use of services to ensure compliance with these Terms and applicable laws.

3.4. Subscriptions and Trial Periods

Use of the services may be subject to limitations, which may include:

  • Restrictions based on different levels of paid subscriptions.
  • Free trial periods with limited or full functionality.
  • Limitations on the number of queries or access to certain tools.

Specific details of each subscription plan or trial period will be clearly communicated at the time of contracting or starting the trial.

4. Intellectual Property Rights

4.1. Ownership of Content

All content made available by Deep Evidence, including, but not limited to texts generated by the tools (respecting original sources), graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is property of the Company or its content suppliers and is protected by Brazilian and international copyright laws. References and contents extracted from scientific articles retain the rights of their respective authors and publications.

4.2. Restrictions on Use

The user is not authorized to:

  • Modify, reproduce (except for personal, non-commercial use), distribute, transmit, publicly display, publish, sell, license, or create derivative works from any content, software, products, or services obtained from or through Deep Evidence, unless expressly authorized in writing by the Company or permitted by the nature of the service (e.g., exporting references).
  • Use any automated process (except APIs, if officially provided) to extract or collect data or content from Deep Evidence.
  • Utilize Deep Evidence services or content for direct commercial purposes (e.g., resale of analyses) without prior written authorization.

4.3. Limited License

The Company grants the user a limited, non-exclusive, non-transferable, and revocable license to access and use the services in accordance with these Terms, exclusively for professional or research purposes related to life sciences and related fields.

4.4. Feedback and Suggestions

Any feedback, comments, or suggestions provided by the user regarding Deep Evidence services will be considered non-confidential and the Company will have the right to use such information without any obligation to the user.

5. User Responsibilities

5.1. Ethical and Legal Use

The user agrees to use Deep Evidence services ethically and in compliance with all applicable laws and regulations, including, but not limited to:

  • Data protection and privacy legislation.
  • Applicable professional and research regulations.
  • Applicable professional ethical standards.

5.2. Accuracy of Information

The user is responsible for ensuring the accuracy and truthfulness of all information provided when using Deep Evidence services, including registration data and formulated questions.

5.3. Account Security

The user is responsible for maintaining the security of their account, including protecting their login credentials and immediately notifying the Company of any suspected unauthorized access.

5.4. Professional Use and Critical Judgment

The user acknowledges and agrees that:

  • Deep Evidence is a tool to support research and decision-making and does not replace qualified professional judgment, critical analysis of original literature, or consultation with experts.
  • All professional, research, or clinical decisions made with the assistance of Deep Evidence are the sole responsibility of the user.
  • It is the user's duty to verify, validate, and contextualize all information provided by Deep Evidence before applying it in their professional practice or research, consulting the primary referenced sources.
  • The use of Deep Evidence does not exempt the professional or researcher from their ethical and legal obligations towards their patients, institutions, funding bodies, or the scientific community.

5.5. Non-Disclosure of Confidential or Sensitive Information

The user agrees not to insert or share through Deep Evidence:

  • Personally identifiable information of patients or research participants that allows their individualization.
  • Confidential institutional data without due authorization.

5.6. Updates and Continuing Education

The user acknowledges that:

  • Life sciences and related fields are constantly evolving.
  • It is the user's responsibility to stay updated with the latest guidelines, best practices, and scientific advancements in their field of practice.
  • Deep Evidence should be used as a supplement, and not as a substitute, for continuing education and critical reading of scientific literature.

5.7. Feedback and Error Reporting

The user is encouraged to:

  • Provide feedback on the accuracy, usefulness, and any limitations of the information provided by Deep Evidence.
  • Report any errors, inconsistencies, or technical problems encountered when using the service immediately.
  • Suggest improvements or new features.

6. Company's Limitations of Liability

6.1. Provision of Service

The Company provides its services "as is" and "as available," without warranties of any kind, express or implied. Specifically:

  • We do not guarantee that the services will be uninterrupted, timely, secure, or error-free.
  • We do not guarantee that the results obtained from the use of the services will always be accurate, complete, or entirely reliable, given the nature of AI and the vast scientific literature.
  • The quality of any information or other material obtained through Deep Evidence must be critically evaluated by the user.

6.2. Accuracy of Information

Although the Company strives to provide accurate information based on reliable sources:

  • We do not guarantee the absolute accuracy, completeness, or timeliness of all information provided, as AI may have limitations and scientific literature evolves rapidly.
  • It is the user's responsibility to verify any information obtained through Deep Evidence, consult original references, and assess its relevance and applicability to any specific situation.

6.3. Use of Information

The Company is not responsible for:

  • Professional, research, clinical, or any other decisions made based (wholly or partly) on information provided by the platform.
  • Any direct, indirect, incidental, consequential, or punitive damages resulting from the use or inability to use the services.
  • Loss of data (except that under our direct storage responsibility), lost profits, or business interruption arising from the use of the service.

6.4. Limitation of Financial Liability

The Company's total liability, if any, for any claims arising from these Terms will be limited to the amount paid by the user for the services in the 12 months preceding the event giving rise to the claim.

6.5. Indemnification

The user agrees to indemnify and hold harmless the Company, its directors, employees, and agents from any claim, demand, loss, liability, and expenses (including attorneys' fees) arising from or related to their misuse of the services, violation of these Terms, or violation of third-party rights.

6.6. Force Majeure

The Company will not be liable for any failure or delay in performing its obligations resulting from causes beyond its reasonable control.

7. Information Security and Data Protection

7.1. Commitment to Security

The Company implements technical and organizational security measures to protect users' personal data, in compliance with LGPD and other applicable laws. These measures include encryption and access controls.

7.2. User Responsibility

The user is responsible for the confidentiality of their credentials and for notifying the Company of any suspected security breach.

7.3. No Storage of Identifiable Patient Data

The user is instructed not to enter information that allows the direct identification of patients or research participants into the system. The responsibility for properly anonymizing data before insertion (if applicable, such as in questions or uploads for "My Article") is of the user.

7.4. Processing of Personal Data

The processing of users' personal data by the Company is governed by our Privacy Policy, which is an integral part of these Terms. We recommend carefully reading the Privacy Policy.

7.5. Data Subject Rights

In accordance with LGPD, the user has specific rights regarding their personal data. To exercise these rights or for any privacy-related inquiries, please contact us via email at contato@deepevidence.ai or as detailed in the Privacy Policy.

8. Modifications to Terms

8.1. Updates to Terms

The Company reserves the right to modify these Terms at any time. Modifications will take effect immediately upon publication of the updated Terms on the deepevidence.ai website or in the application.

8.2. Notification of Changes

We will make reasonable efforts to notify users of significant changes to these Terms, by email or notice on the platform.

8.3. Continued Acceptance

Continued use of the services after the publication of modifications constitutes acceptance of the new Terms. If you do not agree with the modified Terms, you must stop using the services.

9. Termination

9.1. Termination by User

The user may terminate their account at any time by following the procedures indicated on the platform or contacting support.

9.2. Termination by Company

The Company may, at its sole discretion, suspend or terminate the user's access to the services for violation of these Terms or for any other reason, with or without notice.

9.3. Effects of Termination

Upon termination, access to the services will be interrupted. Certain provisions of these Terms will survive termination, including intellectual property, limitations of liability, and dispute resolution.

10. General Provisions

10.1. Entire Agreement

These Terms, together with the Privacy Policy and any applicable additional terms, constitute the entire agreement between the user and the Company regarding Deep Evidence services.

10.2. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

10.3. Waiver

The Company's failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

10.4. Assignment

The user may not assign or transfer these Terms without the Company's prior written consent. The Company may assign these Terms freely.

10.5. Force Majeure

Neither party will be liable for failures or delays in performance due to circumstances beyond their reasonable control.

11. Governing Law and Jurisdiction

11.1. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Federative Republic of Brazil.

11.2. Dispute Resolution

Any dispute arising from or related to these Terms will preferably be resolved through direct negotiation between the parties. If no agreement is reached, the dispute may be submitted to mediation or arbitration, by mutual agreement, or, in its impossibility, to the competent court.

11.3. Jurisdiction

To settle any controversies arising from these Terms that are not resolved by negotiation, mediation, or arbitration, the jurisdiction of the District of Belo Horizonte, State of Minas Gerais, is elected, to the exclusion of any other, however privileged it may be.
